These terms apply to creators. If you run campaigns as a business, the Brand Terms of Service apply to you instead.
1. Acceptance of terms
By accessing or using NewWave’s creator platform (the “Service”), you agree to be bound by these Terms of Service (the “Terms”). If you do not agree to these Terms, you may not use the Service.
2. Eligibility
To use our Service as a creator, you must:
- Be at least 18 years of age.
- Have the legal capacity to enter into a binding agreement.
- Own or have rights to the content you create and share.
- Comply with all applicable laws and regulations.
3. Creator account
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account.
4. Content creation and ownership
You retain ownership of the content you create. By participating in campaigns through NewWave, you grant brands a licence to use your content as specified in individual campaign agreements.
5. Payment terms
Payments are processed based on the payout structure defined in each campaign. You agree that:
- Payments are based on verified performance metrics such as views and engagement.
- Minimum payout thresholds may apply.
- You are responsible for any applicable taxes on your earnings.
- Payment processing may take up to 30 days after performance verification.
6. Content guidelines
All content created through our platform must:
- Be original and not infringe third-party rights.
- Comply with FTC disclosure requirements for sponsored content.
- Not contain illegal, harmful, or offensive material.
- Follow platform-specific guidelines, such as TikTok’s and Instagram’s.
7. Prohibited activities
You may not:
- Use fake engagement, bots, or artificial inflation of metrics.
- Misrepresent your follower count, engagement rates, or demographics.
- Violate campaign terms or brand guidelines.
- Share confidential campaign information with third parties.
8. Termination
We reserve the right to suspend or terminate your account for violations of these Terms. You may also terminate your account at any time by contacting support.
9. Limitation of liability
NewWave is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amounts paid to you in the preceding 12 months.
10. Dispute resolution
Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
11. Changes to these terms
We may update these Terms from time to time. We will notify you of material changes by email or through the platform. Continued use of the Service after changes constitutes acceptance of the updated Terms.
